INTRODUCTION

Welcome to rentinit. These terms and conditions ("Terms") govern your use of the rentinit platform (the "Platform") and the services provided through it (the "Services").

Please read these Terms carefully before using the Platform or Services. By accessing or using our Platform or Services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use our Platform or Services.

DEFINITIONS

In these Terms:

  • "Content" means any information, text, graphics, photos or other materials uploaded, downloaded or appearing on the Platform.
  • "Manager" means a landlord, property manager, or agent who manages property through the Platform.
  • "Platform" means the rentinit website and mobile application.
  • "Property" means any residential rental property on the Platform.
  • "Renter" means a user who uses the Platform to find and rent a Property.
  • "Services" means all services provided by rentinit through the Platform, including but not limited to, property management, tenant matching, digital verification, and payment processing services.
  • "User", "you" or "your" means any person who accesses or uses the Platform or Services.
  • "We", "us", "our" or "rentinit" means rentinit L.L.C-FZ.

ELIGIBILITY

User Eligibility

To use the Platform and Services, you must:

  • Be at least 18 years of age
  • Have the legal capacity to enter into a binding agreement
  • Not be prohibited from using the Platform under the laws of the United Arab Emirates or other applicable jurisdiction

Account Registration

To access certain features of the Platform, you must register for an account. When you register, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Keep your account credentials secure and confidential
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate your account if any information provided during registration or thereafter proves to be inaccurate, not current, or incomplete.

PLATFORM USE AND RESTRICTIONS

Permitted Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to:

  • Access and use the Platform and Services for your personal, non-commercial use if you are a Renter
  • Access and use the Platform and Services to add, manage, and rent Properties if you are a Manager
  • Access and use the Platform and Services in accordance with these Terms

Prohibited Use

You agree not to:

  • Use the Platform or Services for any illegal purpose or in violation of any local, state, national, or international law
  • Violate or infringe other people's rights, including privacy, publicity, intellectual property, or other proprietary rights
  • Harass, threaten, intimidate, or impersonate others
  • Engage in any activity that interferes with or disrupts the Platform or Services
  • Attempt to gain unauthorized access to the Platform or Services, other users' accounts, or systems or networks connected to the Platform
  • Use any robot, spider, crawler, scraper, or other automated means to access the Platform or Services
  • Collect or harvest any personally identifiable information from the Platform
  • Circumvent, disable, or otherwise interfere with security-related features of the Platform
  • Upload viruses or other malicious code or otherwise compromise the security of the Platform
  • Use the Platform or Services in any way not expressly permitted by these Terms

PROPERTY AND RENTAL TERMS

Property Information (for Managers)

If you are a Manager, you agree that:

  • You have the legal right to add and rent the Property
  • All information provided about the Property is accurate, complete, and not misleading
  • The Property complies with all applicable laws, regulations, and codes
  • You will maintain the Property in a safe and habitable condition
  • You are responsible for the content of your property listing and any interactions with potential Renters
  • We reserve the right to remove any property for any reason

Rental Applications (for Renters)

If you are a Renter, you agree that:

  • All information provided in your rental application is accurate, complete, and not misleading
  • You authorize us to verify your information, including identity verification, credit checks, and background checks
  • You are responsible for any interactions with potential Managers
  • Applying for a Property does not guarantee that you will be approved to rent it

Rental Agreements

  • Rental agreements are between Managers and Renters
  • We provide digital tools to facilitate rental agreements but are not a party to these agreements
  • All rental agreements will adhere to the local laws and regulations and be governed by them
  • Where possible, contracting will use the local governing body's legal template
  • Managers and Renters are responsible for ensuring that rental agreements comply with all applicable laws
  • We are not responsible for enforcing rental agreements

VERIFICATION AND PAYMENT SERVICES

Verification Services

  • We provide identity verification services for both Managers and Renters
  • For residents, verification may be conducted through official identity verification systems
  • For non-residents, verification may be conducted through our third-party verification partners
  • Verification does not guarantee the identity or trustworthiness of any User
  • You consent to us collecting, using, and storing your verification information in accordance with our Privacy Policy

Payment Services

  • We facilitate payments between relevant stakeholders including Renters, Managers, and service providers
  • All payments must be made through the Platform
  • You authorize us to charge, process, and disburse payments as directed
  • We may hold funds in escrow as required to facilitate transactions
  • We may charge fees for payment processing as specified on the Platform
  • We comply with all applicable financial regulations

FEES AND PAYMENTS

Fee Structure

  • We charge fees for the use of certain Services as specified on the Platform
  • Fees may be calculated as a percentage of the rental value or as a flat fee
  • We reserve the right to modify our fees at any time with notice
  • All fees are exclusive of taxes unless stated otherwise

Payment Terms

  • All payments must be made through the Platform
  • You agree to pay all applicable fees and taxes
  • You authorize us to charge your designated payment method
  • If your payment method is declined, you agree to provide an alternative payment method
  • We may suspend or terminate your access to the Platform if you fail to pay any fees when due

INTELLECTUAL PROPERTY RIGHTS

Our Intellectual Property

The Platform, Services, and all content, features, and functionality thereof, including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof, are owned by us, our licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

License to Use Content

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Content solely for the purpose of using the Platform and Services.

User Content

By uploading, posting, or otherwise making available any Content on the Platform ("User Content"), you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, and display such User Content in connection with the Platform and Services.

You represent and warrant that:

  • You own or have the necessary rights to the User Content
  • The User Content does not infringe any intellectual property or other rights of any third party
  • The User Content complies with these Terms and all applicable laws and regulations

LIMITATION OF LIABILITY

Disclaimer of Warranties

THE PLATFORM AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE PLATFORM OR SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS IN THE PLATFORM OR SERVICES WILL BE CORRECTED.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE, OUR DIRECTORS, EMPLOYEES, AGENTS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE PLATFORM OR SERVICES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS, THE PLATFORM, OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.

Indemnification

You agree to defend, indemnify, and hold harmless rentinit, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Platform or Services.

TERM AND TERMINATION

Term

These Terms shall remain in full force and effect while you use the Platform or Services.

Termination by You

You may terminate your account at any time by following the instructions on the Platform or by contacting us.

Termination by Us

We may, in our sole discretion, suspend or terminate your access to the Platform and Services at any time for any reason, including but not limited to:

  • Violation of these Terms
  • Providing inaccurate, fraudulent, or misleading information
  • Engaging in behavior that is harmful to other Users, third parties, or us
  • Using the Platform or Services for any illegal purpose
  • Non-payment of any fees due

Effect of Termination

Upon termination:

  • Your right to use the Platform and Services will immediately cease
  • We may delete your account and all associated information
  • Any outstanding payment obligations will remain in effect until satisfied
  • Provisions of these Terms that by their nature should survive termination shall survive termination

DISPUTE RESOLUTION

Governing Law

These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation shall be governed by and construed in accordance with the laws of the United Arab Emirates.

Dispute Resolution

Any dispute arising out of or in connection with these Terms, including any question regarding its existence, validity, or termination, shall be referred to and finally resolved by the courts of Dubai, United Arab Emirates.

Limitation Period

Any cause of action you may have with respect to the Platform or Services must be commenced within one (1) year after the cause of action arises, otherwise, such cause of action is permanently barred.

GENERAL PROVISIONS

These Terms constitute the entire agreement between you and us regarding your use of the Platform and Services and supersede all prior and contemporaneous written or oral agreements between you and us.

Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of these Terms remain in full force and effect.

You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. Any attempt by you to assign or transfer these Terms without such consent will be null and void. We may assign or transfer these Terms, at our sole discretion, without restriction.

CHANGES TO THESE TERMS

We reserve the right to modify these Terms at any time. If we make changes to these Terms, we will post the revised Terms on the Platform and update the "Last Updated" date at the top of these Terms. We will also provide notification of material changes via email or through the Platform.

By continuing to access or use the Platform or Services after the revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, you must stop using the Platform and Services.
